H-1B temporary worker requests and I-129 certification

Research Compliance processes  I-129 “Petition for Nonimmigrant Worker” forms, which we use as part of the H-1B/O-1 temporary worker application process. All H-1B and O-1 requests received by United States Citizenship and Immigration Services must include an I-129, regardless of discipline.

To submit an I-129, e-mail the following materials to [email protected].

  • A photocopy of a current government-issued photo ID of the applicant.
  • A resumé or CV of the applicant.

Research Compliance will then process and return the form to the department — typically within 10 business days.

Export Control review: International Visiting Scholars (J-1 visa-holders) Requests

International visiting scholar applications should obtain an export control review if one or more of the following circumstances applies in the initial application:

  1. The applicant is from a country of concern: China (including Hong Kong and Macau), North Korea, Russia, or Iran
  2. The Export Control Wizard for the applicant’s expected responsibilities and activities says that a license may need to be obtained.
  3. The applicant’s expected responsibilities and activities involve Critical and Emerging Technology.
  4. There are any other potential risks associated with the applicant or their home institution, or, if you are unsure of the risks.

On applications for J-1 extensions, obtain export control re-review if there has been a change in the applicant’s duties (under the extension) that cause one or more of the above circumstances (2, 3, or 4) to apply.

If any of the above circumstances apply, please send [email protected] the following:

  1. A completed copy of the International Visiting Scholars Questionnaire (J1 – Visiting Foreign Scholar for a Non-Immigrant Worker Export Compliance Questionnaire). The form must be signed by the ASU sponsor, Unit Chair, or Director.
  2. Photocopy of a current government-issued photo ID
  3. An up-to-date resume or CV

After reviewing the application, Research Compliance will provide an overview of the risks, if any, associated with the visiting scholar applicant along with resources and best practices for international collaborations for the Unit to make decisions on whether to continue proceeding with the applicant.

Visiting Scholar Agreement: Whether Research Compliance completes an export review or not, if the applicant is not funded by ASU and/or will not be an ASU employee, the Unit is responsible for obtaining a fully executed Visiting Scholar Agreement signed by the Sponsoring Department Chair/Dean, the ASU Principal Investigator (named in agreement Article 4 Point of Contact), and the visiting applicant, and submitting all required paperwork to the International Students and Scholars Center (ISSC). On applications for J-1 extensions, the Unit is also responsible for obtaining a fully executed Visiting Scholar Agreement that reflects the extension period. Visitors and International Traffic in Arms Regulations controlled projects

Form: ITAR Visit Request.

You should complete this form for visitors that need access to an ITAR controlled project at ASU. The form is completed by the Facilities Security Officer of the organization that the visitor represents. All visitors on ITAR projects must be U.S. persons as defined by the regulations.

Additionally, ASU personnel may be asked to complete a similar type form to visit a government or industry site. Upon receipt of one of these forms from a sponsor, contact us for guidance.
