Is there language in the award documentation stating the research to be performed is fundamental?  

Fundamental Research means basic and applied research in science and engineering, where the resulting information is shared broadly within the scientific community.  Fundamental research, by definition, is free of access, participation or dissemination restrictions.

Possible restrictions eliminating fundamental research:

• Publication and dissemination restrictions beyond a brief review.
• Foreign participation restrictions.
• Export control material/data required in project.
